These Terms of Use ("Terms") govern your access to and use of the website operated by North Path Residences, LLC ("North Path," "we," "us," or "our"), including any pages, forms, and online features available at northpathresidences.com (the "Site"). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy and Refund & Payment Policy. If you do not agree, please do not use the Site.
1. What we provide
North Path provides information about independent shared housing in Central Florida and lets you join a waitlist, submit an application, request a tour, or inquire about partnering with us. North Path provides housing only. We do not provide medical care, nursing, personal care, assistance with activities of daily living, medication administration or management, transportation, meals served by staff, counseling, or supervision. Nothing on the Site is medical, legal, financial, or professional advice.
2. No housing agreement is created by the Site
Submitting any form on the Site — including a waitlist signup, application, tour request, or inquiry — does not create a tenancy, lease, reservation, or any right to occupy a home, and does not obligate North Path to provide housing. A right to occupy is created only by a written License-to-Occupy Agreement signed by you and North Path. Until such an agreement is signed, North Path may decline or discontinue any application for any lawful reason.
3. Eligibility and applications
Our homes are designed for adults who can live independently — including self-administering their own medications, arranging their own care and transportation, preparing their own meals, and self-evacuating the home. You must be at least 18 years old to use the Site or submit an application. You agree that all information you provide is true, accurate, and complete, and you authorize us to verify it, including through background and reference screening where permitted by law.
4. Fair housing
North Path is an equal-opportunity housing provider. We do not discriminate on the basis of race, color, national origin, religion, sex, familial status, disability, or any other class protected by the federal Fair Housing Act or applicable Florida law. We will consider reasonable accommodations and modifications for persons with disabilities consistent with our housing-only model and applicable law.
5. Payments
Pricing, fees, and availability shown on the Site are subject to change and are confirmed only in your signed License-to-Occupy Agreement. Payments are processed by our third-party payment processor, Stripe, Inc. By making a payment you also agree to Stripe's terms and authorize the applicable charges. North Path does not store full card numbers. Refunds and billing are governed by our Refund & Payment Policy and your signed agreement.
6. Electronic documents and signatures
North Path may send documents for electronic review and signature. By signing electronically, you consent to do business electronically and agree that your electronic signature is legally binding under the federal ESIGN Act and Florida's Uniform Electronic Transaction Act. You may request a paper copy of any document you sign by contacting us.
7. Acceptable use
You agree not to use the Site to break any law; to submit false, misleading, or fraudulent information; to upload malicious code; to attempt to gain unauthorized access to our systems or accounts; to scrape or harvest data; or to interfere with the Site's operation or other users' use of it.
8. Intellectual property
The Site and its content — including the North Path name, logo, text, graphics, and design — are owned by North Path or its licensors and are protected by applicable intellectual-property laws. You may not copy, reproduce, or use them without our prior written permission, except for your own personal, non-commercial reference.
9. Third-party services and links
The Site relies on and may link to third-party services (for example, payment processing, email delivery, hosting, and analytics). We are not responsible for the content, policies, or practices of third parties. Your use of those services is governed by their own terms.
10. Disclaimers
The Site is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that information on it is current or complete.
11. Limitation of liability
To the fullest extent permitted by law, North Path and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or goodwill, arising out of or related to your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred dollars ($100), except where a greater amount is required by law.
12. Indemnification
You agree to indemnify and hold harmless North Path from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms or applicable law.
13. Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute relating to the Site will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. Changes are effective when posted, and the "Last updated" date above reflects the most recent revision. Your continued use of the Site after changes are posted means you accept the updated Terms.
